Vonage Laughs Off Patent Verdict- Analysts Disagree

Following the jury verdict that found it guilty of infringing on three Verizon patents, Vonage did what any self-respecting public company would in order to keep customers and investors from panicking: It put a positive spin on things. As our blog today noted, the consumer VoIP pioneer came out with statements variously indicating that the verdict was in some ways a victory; that it could have been a lot worse; and that, in the larger scheme of things, it won't make all that much difference. The last may be closer to the mark than it realizes.
It was a victory, according to one of the statements, because Vonage had been "Vindicated on Four of Seven Patents." It could have been worse because the jury only awarded Verizon $58 million, rather than the $197 million it asked for. And it won't make much difference for several reasons. First, Vonage was sure the verdict would be reversed on appeal. Second, it would request a stay if the judge granted an injunction against using Verizon's patents. And third, in the "unlikely event" that both the monetary award and the 5.5 percent royalties on future revenues the jury also ordered it to pay Verizon are upheld, they "will not jeopardize Vonage's financial position as we focus on achieving profitability."
